Kung Fu Panda 4 Colouring Competition and Win a Trip to China Campaign Terms and Conditions

Introduction

a. The Kung Fu Panda 4 Colouring Competition and the Win a Trip to China Campaign (collectively, the “Competitions”) are organised by Gong cha Australia (the “Organiser”).
b. By participating in these Competitions, entrants agree to be bound by these terms and conditions.

Eligibility

a. The Competitions are open to individuals of all ages living in Australia.
b. Employees of the Organiser, their immediate family members, and anyone professionally connected with the Competitions are not eligible to participate.

How to Enter

a. Colouring Competition:

  1. To enter the Colouring Competition, Participants must follow @gongcha_australia on Instagram,
  2. Download the colouring template from the Gong cha Australia web page or via this link,
  3. Post the completed artwork directly on the Participants’ Instagram account, tagging @gongcha_australia in the post (the Entry).
  4. Entries must be submitted by 12pm on 12 April 2024, Sydney Local Time.
  5. Only one entry per Participant is allowed.

b. Win a Trip to China Campaign:

  1. To enter the Win a Trip to China Campaign, Participants must follow @gongcha_australia on Instagram
  2. Post a picture or video with Gong cha’s store, drinks, social media or “Kung Fu Panda 4” movie on Participants’ Instagram account, tagging @gongcha_australia in the post (the Entry).
  3. Entries must be submitted by 12pm on 19 April 2024, Sydney Local Time.
  4. Only one entry per Participant is allowed.

Prizes

a. Colouring Competition:

  1. Ten winners, each will receive a Goodie Bag from Universal and Gong Cha and a Double Pass to see the Kung Fu Panda 4 movie.
  2. Forty Winners, each will receive a Double Pass to see the Kung Fu Panda 4 movie.

b. Win a Trip to China Campaign (value up to $16,560):

  1. One winner, and will receive:
    1. Return economy flight tickets for a maximum of four travellers from the nearest Australian capital city to Chengdu, China
    2. 5 nights of shared hotel accommodation for a maximum of four travellers
    3. Private panda tour
    4. Tuk-tuk evening food tour
    5. $1,000 spending money
    6. The trip may not be available during Chinese or Australian Public or National holiday periods.
    7. Travel must be completed by 31 December 2024. All elements are subject to availability at the time of booking.
    8. Travel dates must be confirmed within forty-five (45) calendar days of notification.
    9. The Winner and Travelling Companions must meet travel requirements for international flights, such as age, visa and fitness restrictions.
    10. The Winner must provide the bank details for the EFT transfer for the AUD $1,000 spending money within 45 days of notification.
    11. The Winner must present a valid credit card at hotel check-in for incidentals.
    12. Tickets for Flight, Accommodation, Entertainment, and so forth are non-transferable (i.e. no name changes allowed). Once tickets are issued, they are non-endorsable and non-transferable. Any alterations to confirmed flights and/or accommodation details will be at the expense of the Winner.
    13. All components of the prize must be fulfilled simultaneously, and they cannot be split across different periods.
    14. Flights are economy class and may be indirect. The airline’s Conditions of Carriage apply to all flights. The Winner and Travelling Companions must travel simultaneously and are responsible for transport from their residence to their nearest Capital City Airport in Australia.
    15. The airline, flight route, and dates of travel are subject to the Organiser’s absolute and final decision.
    16. The Winner and Travelling Companions travel at their own risk.
    17. The Winner must obtain their own travel insurance and provide proof of insurance before tickets are issued.
    18. The Winner is solely responsible for obtaining all visas, permissions and other documentation required for entering and staying in China and shall provide to Flight & and Accommodation Broker evidence of such confirmed visas, permissions, as well as all other required travel documentation, no later than forty-five (45) calendar days of the winner being notified of their win.
    19. Once the Winner has provided their details and the Flight and Accommodation Broker has confirmed receipt of such information, any alterations to confirmed flights, accommodation, and/or scheduling arrangements will be at the winner’s expense, including an administration fee of $250, excluding GST, which must be settled in full before booking confirmation.
    20. Individual supplier terms and conditions apply.

Winner(s) Selection

a. Colouring Competition:

  1. The Organiser will choose 50 entries and the respective prizes at its own discretion on 13 April 2024, Sydney Local Time.

b. Win a Trip to China Campaign:

  1. The Organiser will choose 4 entries at 5pm on 19 April 2024 Sydney Local Time.
  2. The Organise will open a poll of the chosen entries on its Instagram account by 10am on 20 April 2024, Sydney Local Time
  3. The public can vote for their favourite entry in the poll until 12pm, 26 April 2024, Sydney Local Time.
  4. The entry with the most votes will be declared as the winner.
  5. In the event of a tie, the Organiser will make the final decision in selecting the winner.

Prize Distribution

a. Colouring Competition:

  1. Winners will be contacted via Instagram from 10am on 16 April, for prize claims.
  2. Prizes will be delivered to the winners’ provided physical addresses or email addresses within 14 days of the contact.

b. Win a Trip to China Campaign:

  1. The winner will be contacted via Instagram on 29 April for a prize claim.
  2. Itinerary will be arranged between the winner and the Organiser or the Organiser’s associates.

Intellectual Property

a. By entering the Competitions, Participants grant the Organiser a non-exclusive, worldwide, royalty-free license to use, reproduce, and display their artwork and/or posted content for promotional purposes related to the Competitions.

Modification of Terms and Conditions

a. The Organiser reserves the right to modify, suspend, or terminate the Competitions, or any part thereof, for any reason, including but not limited to if fraud, technical failures, or any other factor beyond the Organiser’s reasonable control impairs the integrity or proper functioning of the Competitions, as determined by the Organiser in its sole discretion.
b. The Organiser reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Competitions or to be acting in violation of these terms and conditions or in an unsportsmanlike or disruptive manner.
c. Any attempt by any person to deliberately undermine the legitimate operation of the Competitions may be a violation of criminal and civil law, and, should such an attempt be made, the Organiser reserves the right to seek damages from any such person to the fullest extent permitted by law.
d. The Organiser reserves the right to modify these terms and conditions without prior notice. Continued participation in the Competitions after these changes will be considered acceptance of the revised terms and conditions.

Disputes

a. Except where prohibited, each participant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Competitions or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New South Wales, Australia.
b. All issues and questions concerning the construction, validity, interpretation, and enforceability of these terms and conditions, participant’s rights and obligations, or the rights and obligations of the Organiser in connection with the Competitions shall be governed by and construed in accordance with, the laws of New South Wales, Australia, without giving effect to any choice of law or conflict of law rules (whether of New South Wales or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New South Wales, Australia.
c. If any provision of these terms and conditions is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced to the fullest extent permitted by law.
d. The Organiser’s failure to enforce any term of these terms and conditions shall not constitute a waiver of that provision.

Liability

a. The Organiser is not responsible for any lost, late, or misdirected entries or technical issues that may affect participation in the Competitions.
b. The Organiser reserves the right to disqualify any participant who violates these terms and conditions or engages in any fraudulent activity.

Privacy

a. Personal information collected from participants will be used solely for the purpose of administering the Competitions and will not be shared with third parties except as required by law.

Governing Law

a. The Competitions and these terms and conditions are governed by the laws of New South Wales, Australia.
